By accessing or using ReferYes ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Platform. These terms apply to all visitors, users, sourcers, hiring managers, and any other parties who access the service.
ReferYes is an online recruitment marketplace that connects hiring managers, professional sourcers, and job seekers. Sourcers may submit candidate referrals for open positions posted by employers. Employers may review and engage with referred candidates. Job seekers may browse open roles and apply directly.
You must create an account to access most platform features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate, complete, and current information during registration and keep your profile up to date.
By submitting a referral, you confirm that you have a genuine professional relationship with the referred candidate, that the candidate is aware they are being referred (or that you have obtained their consent), and that all information provided is accurate and truthful. Fabricated or fraudulent referrals will result in account termination.
Employers posting jobs agree to provide accurate job descriptions and to honor the referral payout terms specified at the time of posting. Employers must pay the agreed finder's fee upon confirming a successful hire. Deliberate evasion of platform referral fees is prohibited and may result in legal action.
ReferYes facilitates referral fee payments between employers and sourcers. All fees are governed by the terms set at the time of job posting. Payouts to sourcers are processed through the platform wallet system. ReferYes reserves the right to adjust platform fees with reasonable notice.
You agree not to use the Platform to post false, misleading, or fraudulent content; to harvest or scrape user data; to circumvent platform fee structures by conducting referral transactions outside the platform; to harass, spam, or harm other users; or to engage in any activity that violates applicable law.
All content, trademarks, logos, and software associated with ReferYes are the property of ReferYes or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent. User-submitted content (such as job descriptions and referral notes) remains owned by the submitter, but you grant ReferYes a license to display and transmit it within the Platform.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. ReferYes does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. ReferYes does not guarantee the accuracy of job listings, candidate profiles, or referral outcomes.
To the fullest extent permitted by law, ReferYes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability to you for any claim shall not exceed the fees paid by you to ReferYes in the twelve months preceding the claim.
ReferYes reserves the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall continue in effect.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
ReferYes may update these Terms of Use at any time. We will notify registered users via email or in-platform notification when material changes are made. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms.
ReferYes is currently in beta. As a beta user, you acknowledge that the Platform may contain bugs, incomplete features, or unexpected behavior. Features, pricing, and functionality are subject to change without notice during the beta period. Your feedback is valuable and may be used to improve the service. ReferYes reserves the right to modify, suspend, or discontinue beta features at any time. Data generated during beta may be reset or migrated at the platform's discretion. By participating in the beta program, you agree to these additional terms and understand that the service is provided on a best-effort basis.
